Terms of Service

These Terms of Service (the "Terms") are an agreement between you and the Beauty Passport team ("Beauty Passport", "we", "us") covering your use of the Beauty Passport website and installable web app at joinbeautypassport.com (the "Service"). Please read them. By creating an account or using the Service, you accept these Terms. If you do not accept them, do not use the Service. They are written to be read rather than to impress, and they are scheduled for attorney review.
1. The beta service
The Service is an early beta and is provided free of charge during the hair beta. Features may change, move or be removed, data models may change, and the Service may be unavailable, interrupted or reset at times. We do not promise any level of availability, support response time or data durability during the beta. Please keep your own copies of anything you cannot afford to lose.
2. Eligibility
You must be at least 18 years old and legally able to enter into this agreement to use the Service. If you use the Service on behalf of a salon or business, you confirm you are authorized to accept these Terms for that business.
3. Your account
- Provide accurate information when you register, and keep your email address current so we can reach you.
- You are responsible for everything that happens under your account and for keeping your sign-in details private. Do not share your password.
- Tell us promptly at hello@joinbeautypassport.com if you believe someone else has gained access to your account.
- One person, one account. Do not create an account for anyone else or impersonate another person or business.
4. Your content
"Your Content" means the entries, appointments, notes, goals, photos and other material you add to the Service. You keep all rights you have in Your Content. We claim no ownership of it.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, transmit and create technical derivatives of Your Content (for example thumbnails and format conversions) solely to operate, secure and provide the Service to you and to anyone you choose to share with. This license ends when you delete the content or your account, subject to the retention described in the Privacy Policy.
You represent that you have the rights necessary to add Your Content and that it does not infringe anyone's rights or break the law. Only add photos of other people with their permission. We may remove content that violates these Terms.
5. Acceptable use
- Do not upload unlawful, infringing, harassing, hateful, deceptive or sexually exploitative content, or someone else's photos without their permission.
- Do not attempt to access another person's Passport or account, or any part of the Service you are not authorized to use.
- Do not probe, scan, overload, disrupt or reverse engineer the Service, circumvent rate limits or security controls, or use automated tools to scrape it.
- Do not use the Service to send unwanted, bulk or deceptive email, and use invitations only to invite people you actually know.
- Do not resell, sublicense or white-label the Service, or use it to build a competing product.
- Do not upload malware, or use the Service in a way that breaks applicable law or infringes intellectual property.
6. Beauty professionals
Beauty Passport does not employ, endorse, supervise or vouch for any salon or beauty professional, and it does not guarantee the quality, safety, licensing or outcome of any service you receive in person. Any appointment, price or service is a matter between you and the professional or salon. Notes written by a professional come from that professional, not from us. Verification steps in the Service, where offered, are a basic check and not a guarantee.
7. Not medical or professional advice
The Service supports non-medical hair and grooming services. Care guidance shown in the Service is general information, not personalized professional, cosmetological or medical advice, and it is not a substitute for consulting a qualified professional or a doctor. Do a patch test where a product recommends one, and stop using any product that irritates your skin or scalp.
8. Third-party links, products and affiliate disclosure
Product suggestions link to SalonInteractive and other third-party stores that have their own terms, privacy policies, pricing, availability, shipping and returns. Beauty Passport does not sell, stock, ship, warrant or service any product, and we are not responsible for third-party sites or your transactions with them. We may earn a commission on purchases made through those links; this does not change the price you pay and does not determine which products we suggest.
9. Our intellectual property
The Service, including its software, design, text, graphics and the Beauty Passport name and marks, belongs to us or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial use, or for your salon's internal use where you use professional features. All rights not expressly granted are reserved.
10. Copyright complaints
If you believe content on the Service infringes your copyright, email hello@joinbeautypassport.com with a description of the work, the location of the content, your contact details, and a statement that you have a good-faith belief the use is unauthorized. We will review and may remove the content and terminate repeat infringers.
11. Privacy
Our handling of information is described in the Privacy Policy and the Cookie Policy, which form part of these Terms.
12. Feedback
If you send us ideas or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free right to use them without obligation or compensation to you. You keep any rights you have in your own underlying work.
13. Suspension and termination
You may stop using the Service and delete your account at any time from inside the Service. We may suspend or terminate your access, with or without notice, if you break these Terms, misuse the Service, create legal risk for us, or if we discontinue the Service. On termination, the license you granted us to operate the Service ends and your content is removed in line with the Privacy Policy. Sections that by their nature should survive termination will survive, including sections 4, 9, 12, 14, 15, 16 and 17.
14. Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy or that the Service will be uninterrupted, secure or error-free. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
15. Limitation of liability
To the maximum extent permitted by law, neither Beauty Passport nor its team, suppliers or licensors will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost goodwill, or lost, corrupted or unavailable content or data, arising out of or relating to the Service, even if we were advised of the possibility.
To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred United States dollars (US$100). Because the beta is free, this will usually be US$100. Nothing in these Terms limits liability that cannot be limited by law, including for fraud, gross negligence or willful misconduct.
16. Indemnity
You agree to indemnify and hold Beauty Passport harmless from claims, damages, losses and reasonable legal fees arising from Your Content, your use of the Service, or your breach of these Terms, except to the extent caused by us.
17. Governing law and disputes
These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in Clark County, Nevada, and each of us waives any objection to venue there. Before filing anything, please email hello@joinbeautypassport.com so we can try to resolve the issue informally within 30 days. Nothing here prevents either party from seeking injunctive relief, or you from bringing a claim in small-claims court or complaining to a regulator where the law allows.
18. Changes to these Terms
We may update these Terms as the Service develops. The date at the top shows the last update, and we will give notice in the Service or by email for material changes. Continuing to use the Service after a change means you accept the updated Terms.
19. General
- Entire agreement: these Terms, with the Privacy Policy and Cookie Policy, are the whole agreement between you and us about the Service.
- Severability: if a provision is unenforceable, the rest stays in effect.
- No waiver: not enforcing a provision is not a waiver of it.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
- No third-party beneficiaries.
- Force majeure: neither party is liable for delays caused by events beyond its reasonable control.
- Notices: we may send notices to the email on your account; send notices to us at hello@joinbeautypassport.com.
